UPDATED

NOV 15, 2022

These Intellectual Property Reporting API Terms (“Terms”) are made and entered into by and between Meta Platforms, Inc. and Meta Platforms Ireland Limited (“Meta”) and the person or entity accepting these Terms (“You” or “you”). These Terms are deemed accepted and agreed to by you on the date that you indicate your assent to these Terms, such as by clicking “agree” (“Effective Date”). If you are accepting on behalf of a legal entity, you represent and warrant that you are an authorized representative of such entity with the authority to bind it to these Terms.

  • Meta hereby grants you a limited right and license to use the Intellectual Property Reporting API (“Tool”) for the purposes of submitting intellectual property reports to Meta.

  • You confirm that you have not knowingly submitted, and will not knowingly submit, false or erroneous reports to Meta alleging infringement by third parties. Any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages pursuant to section 512(f) of the Digital Millennium Copyright Act (“DMCA”) or similar laws in other jurisdictions.

  • You acknowledge and agree that Meta may share the contact information that you specify via the Tool, including your name and email address, the name of the organization or client who owns the content in question, and/or the contents of your report (your “API Contact Information”) to the person(s) responsible for posting the content you claim to be infringing or others.

  • You acknowledge that you may only use the Tool for the sole purpose of reporting intellectual property violations for content in which you own, or are authorized to report on behalf of the content owner. You further acknowledge that the work and ownership information you provide is accurate.

  • The Tool is provided "as is," and we make no guarantees that it will function without disruptions. To the extent permitted by law, we also disclaim all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. If the Tool is inaccessible, disrupted, or otherwise not functioning, for any reason, you agree to submit intellectual property reports using Meta’s publicly accessible intellectual property reporting forms and waive all claims whatsoever against Meta related to the Tool’s inaccessibility or disruption.

  • You acknowledge that any breach of these and other applicable terms or misuse of the Tool may result in termination of your access to the Tool and Facebook or Instagram, or other Meta services. Meta may modify, suspend or terminate access to, or discontinue the availability of, the Tool at any time.

These Terms govern your use of the Intellectual Property Reporting API. The Tool is part of “Meta Products” under Meta’s Terms of Service (currently at https://www.facebook.com/legal/terms, the “Meta Terms”), and your use of the Tool is deemed part of your use of Meta Products. In the event of any conflict or inconsistency between these Terms and the Meta Terms, the provisions of these Terms will control, but only with respect to the subject of these Terms. Meta reserves the right to monitor or audit your compliance with these Terms and to update these Terms from time to time, and your continued use of the Tool constitutes acceptance of those changes.
